J&L Horton LLC offers this website, including all information, content, tools, products, registrations, merchandise, event-related services, sponsorship opportunities, media opportunities, and other services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, waivers, releases, disclaimers, and notices stated here.

By visiting our website, purchasing merchandise, registering for an event, applying as a sponsor or vendor, submitting media credentials, submitting information, using any online form, or using any part of this website, you engage in our “Service” and agree to be bound by these Terms of Service, including any additional terms, conditions, rules, waivers, releases, and policies referenced herein, posted on the website, provided by email, included in event materials, displayed at an event, or otherwise made available by us.

These Terms of Service apply to all users of the site, including without limitation browsers, customers, racers, drivers, co-drivers, spectators, crew members, media representatives, vendors, sponsors, merchants, contributors of content, and any other person or entity accessing or using the website or participating in any related service.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of this site, you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions of this agreement, you may not access the website, purchase products, register for events, or use any services.

Any new features, products, registrations, merchandise, events, tools, or services added to the current store shall also be subject to these Terms of Service. We reserve the right to update, change, modify, or replace any part of these Terms of Service at any time by posting updates or changes to our website. It is your responsibility to review this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our online store is hosted on Shopify Inc. Shopify provides the e-commerce platform that allows us to sell products and services to you.

We reserve the right to refuse service, deny registration, cancel orders, deny entry, remove participants, remove spectators, reject media requests, reject sponsorships, reject vendor applications, or limit access to any person or entity for any lawful reason at any time.

You understand that your content, not including credit card information, may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is encrypted during transfer over networks according to applicable payment processing standards.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, republish, distribute, modify, or otherwise misuse any portion of the Service, use of the Service, access to the Service, event materials, rules, route materials, sponsor materials, registration materials, images, videos, logos, written content, or any contact on the website through which the Service is provided, without express written permission from us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We make reasonable efforts to provide accurate and current information, but we do not guarantee that information made available on this site is accurate, complete, current, error-free, or suitable for your particular purpose. Event information, schedules, dates, times, locations, routes, checkpoints, rules, payouts, sponsor listings, vendor details, class information, registration details, safety information, merchandise information, and pricing may change at any time.

This site may contain historical information. Historical information is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information unless required by law. You agree that it is your responsibility to monitor changes to the website, event materials, emails, social media posts, and official event communications.

SECTION 4 - MODIFICATIONS TO THE SERVICE, EVENTS, AND PRICES

Prices for products, merchandise, registrations, sponsorships, vendor opportunities, media services, advertising, and other services are subject to change without notice.

We reserve the right to modify, suspend, reschedule, postpone, cancel, limit, substitute, or discontinue the Service, an event, any part of an event, any class, any route, any track date, any checkpoint, any schedule, any payout, any merchandise item, or any website content without notice at any time.

We shall not be liable to you or any third party for any modification, price change, suspension, delay, postponement, cancellation, rescheduling, substitution, or discontinuance of the Service, event, merchandise, registration, sponsorship, vendor opportunity, or any part thereof.

SECTION 5 - PRODUCTS, REGISTRATIONS, AND SERVICES

Certain products, registrations, merchandise, event services, sponsorship opportunities, vendor opportunities, media opportunities, and other services may be available exclusively online through the website. These items may have limited availability and are subject to return, refund, cancellation, or exchange only according to our Refund Policy and any event-specific rules.

We make reasonable efforts to display as accurately as possible the colors, images, sizes, descriptions, pricing, availability, and details of products and services that appear on the store. We cannot guarantee that your computer monitor, mobile device, browser, or printer will accurately show any color, image, size, or detail.

We reserve the right, but are not obligated, to limit sales of products, registrations, merchandise, sponsorships, vendor opportunities, or services to any person, business, entity, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit quantities of any products, registrations, merchandise, or services that we offer. All descriptions, availability, pricing, and details are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product, registration, event service, merchandise item, sponsorship, vendor opportunity, or offer at any time.

Any offer made on this site is void where prohibited.

We do not warrant that the quality of any products, services, registrations, merchandise, information, or other material purchased or obtained by you will meet your expectations, that you will be accepted into any event or class, that an event will occur as originally planned, or that any errors in the Service will be corrected.

SECTION 6 - SHIPPING, DELIVERY, AND MERCHANDISE

Shipping times, delivery dates, production times, and fulfillment estimates are estimates only unless expressly stated otherwise. We are not responsible for shipping carrier delays, incorrect addresses, lost packages caused by carrier error, customs delays, weather delays, or other circumstances outside our control.

You are responsible for providing accurate shipping and contact information. We are not responsible for delays, failed deliveries, returned packages, or additional charges caused by incorrect, incomplete, outdated, or undeliverable information provided by you.

If merchandise is unavailable, delayed, discontinued, damaged before shipment, or otherwise unable to be fulfilled, we may cancel the order, offer a substitute, issue a refund, or provide another remedy at our discretion and as required by applicable law.

Merchandise returns, exchanges, and refunds are governed by our Refund Policy.

SECTION 7 - EVENT REGISTRATION AND PARTICIPATION

Event registrations, racer entries, co-driver entries, crew access, spectator access, sponsorships, vendor opportunities, media credentials, and other event-related purchases may be subject to additional rules, requirements, schedules, procedures, safety requirements, class rules, technical inspection requirements, track rules, driver packets, route instructions, waiver forms, and event policies.

By registering for, attending, entering, working, sponsoring, vending, covering, or participating in a Street Car Challenge event, you agree to follow all event rules, track rules, safety requirements, technical requirements, staff instructions, law enforcement instructions, venue requirements, and applicable laws.

Failure to follow event rules, safety requirements, technical requirements, payment requirements, class rules, staff instructions, track rules, or lawful instructions may result in denial of entry, disqualification, removal from the event, loss of points, loss of payout eligibility, cancellation of registration, refusal of future participation, or other corrective action without refund.

We reserve the right to accept, reject, suspend, cancel, or revoke any registration, entry, credential, sponsorship, vendor approval, or media approval at our sole discretion.

Event dates, times, locations, tracks, routes, checkpoints, schedules, classes, passes, payouts, activities, and awards may be changed, postponed, canceled, shortened, extended, or adjusted due to weather, safety concerns, track conditions, road conditions, staffing, permitting, insurance requirements, low participation, facility availability, law enforcement direction, emergency conditions, force majeure, or circumstances beyond our control.

SECTION 8 - MOTORSPORTS RISK, ASSUMPTION OF RISK, AND PARTICIPANT RESPONSIBILITY

You understand and agree that motorsports, drag racing, road travel, event attendance, vehicle operation, vehicle modification, vehicle testing, and related activities are dangerous and involve inherent and significant risks. These risks include but are not limited to property damage, vehicle damage, mechanical failure, fire, explosion, collision, bodily injury, disability, paralysis, illness, emotional distress, economic loss, and death.

You knowingly and voluntarily assume all risks associated with registering for, attending, participating in, traveling to, traveling from, working at, sponsoring, vending at, or otherwise being involved with any Street Car Challenge event or related activity.

You are solely responsible for your vehicle, equipment, tools, trailer, fuel, tires, safety gear, insurance, licensing, registration, compliance, fitness to participate, physical condition, driving decisions, route decisions, mechanical preparation, and compliance with laws and event rules.

You are responsible for inspecting and determining whether your vehicle, equipment, safety gear, and conduct are suitable for participation. Any technical inspection, rule review, or event staff approval is not a warranty, guarantee, certification, or representation that your vehicle, equipment, safety gear, or participation is safe, legal, compliant, or fit for use.

You agree that you participate at your own risk.

SECTION 9 - RELEASE OF LIABILITY

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue J&L Horton LLC, Street Car Challenge, event owners, organizers, officers, employees, contractors, staff, volunteers, representatives, agents, sponsors, advertisers, vendors, media partners, service providers, affiliates, track owners, track operators, venues, property owners, property managers, insurers, and all related parties from any and all claims, demands, causes of action, damages, costs, expenses, injuries, losses, liabilities, or obligations of any kind arising out of or related to your access to the website, purchase of products, registration for events, attendance at events, participation in events, travel to or from events, use of routes or checkpoints, use of event information, use of merchandise, or interaction with any event-related activity.

This release includes, without limitation, claims arising from ordinary negligence, premises conditions, event operations, scheduling changes, route changes, track conditions, weather, mechanical failure, vehicle damage, collision, fire, theft, personal injury, illness, death, property loss, economic loss, lost profits, travel costs, lodging costs, missed work, missed participation, disqualification, or removal from an event.

This release does not apply where prohibited by law.

SECTION 10 - INDEMNIFICATION AND HOLD HARMLESS

You agree to indemnify, defend, and hold harmless J&L Horton LLC, Street Car Challenge, event owners, organizers, officers, employees, contractors, staff, volunteers, representatives, agents, sponsors, advertisers, vendors, media partners, service providers, affiliates, track owners, track operators, venues, property owners, property managers, insurers, and all related parties from and against any claim, demand, lawsuit, liability, loss, injury, damage, judgment, settlement, fine, penalty, cost, or expense, including reasonable attorneys’ fees, arising out of or related to:

your breach of these Terms;
your violation of any law, rule, regulation, or third-party right;
your purchase or use of any product or service;
your registration for, attendance at, or participation in any event;
your vehicle, trailer, equipment, tools, crew, guests, or invitees;
your driving, conduct, statements, submissions, content, or actions;
your failure to follow rules, instructions, safety requirements, or laws;
any claim brought by your guest, crew member, co-driver, passenger, minor, invitee, employee, contractor, representative, or affiliated person.

This obligation survives termination of these Terms and survives the conclusion of any event.

SECTION 11 - MINORS

Minors may not register for, purchase, attend, or participate in certain services or events without permission from a parent or legal guardian where required. A parent or legal guardian is responsible for the conduct, safety, supervision, and legal compliance of any minor attending or participating in any event.

A parent or legal guardian who registers, signs up, purchases for, brings, permits, or authorizes a minor to attend or participate agrees to these Terms on behalf of the minor and agrees to indemnify and hold harmless J&L Horton LLC, Street Car Challenge, and all released parties from claims related to the minor to the fullest extent permitted by law.

Additional minor waivers, releases, track forms, or guardian signatures may be required before participation or entry.

SECTION 12 - EVENT WAIVERS AND TRACK REQUIREMENTS

These Terms of Service are not a substitute for any separate event waiver, track waiver, participant release, media release, vendor agreement, sponsorship agreement, driver agreement, technical inspection form, or other document required for participation.

You may be required to sign additional documents before receiving entry, credentials, access, approval, or participation privileges. Refusal to sign required documents may result in denial of entry, denial of participation, removal, cancellation, or disqualification without refund.

Track operators, venues, property owners, insurers, and event staff may impose additional rules, requirements, releases, waivers, or safety procedures. You agree to comply with all such requirements.

SECTION 13 - NO GUARANTEE OF EVENT OUTCOME, PAYOUT, OR PARTICIPATION

We do not guarantee that any racer, sponsor, vendor, spectator, media representative, or participant will receive a particular result, placement, payout, benefit, exposure, social media reach, sales volume, audience size, track time, number of passes, number of route miles, number of checkpoints, or level of participation.

Payouts, awards, points, class structures, sponsor benefits, vendor benefits, media access, and event activities are subject to posted rules, eligibility requirements, technical requirements, attendance, weather, track conditions, sponsorship availability, event completion, and final determination by event staff.

We reserve the right to correct mistakes, resolve disputes, adjust results, deny payouts, withhold awards, disqualify participants, or make final decisions regarding event operations and eligibility.

SECTION 14 - REFUNDS, CANCELLATIONS, CHARGEBACKS, AND PAYMENT DISPUTES

Refunds, cancellations, exchanges, and credits are governed by our Refund Policy and any event-specific rules.

Unless otherwise stated in writing, event registrations, sponsorships, vendor fees, media fees, deposits, and special event purchases may be non-refundable due to limited availability, planning costs, venue costs, insurance costs, staffing costs, production costs, administrative costs, and other expenses incurred before the event.

Weather, schedule changes, track changes, route changes, shortened events, postponed events, force majeure events, disqualification, removal, failure to attend, mechanical failure, vehicle damage, travel delays, personal conflicts, or failure to follow rules do not automatically entitle you to a refund.

By purchasing through this website, you agree not to file a false, fraudulent, or improper chargeback. If you initiate a chargeback or payment dispute that is inconsistent with these Terms, our Refund Policy, or the facts of the transaction, you agree that we may provide these Terms, order records, registration records, event records, correspondence, tracking information, and other evidence to the payment processor, card issuer, or dispute-resolution provider.

You are responsible for any fees, costs, collection expenses, or reasonable attorneys’ fees incurred by us in connection with unpaid balances, improper chargebacks, fraudulent transactions, or collection of amounts owed, to the fullest extent permitted by law.

SECTION 15 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel purchases made per person, household, business, racer, sponsor, vendor, team, account, payment method, billing address, shipping address, or order.

If we make a change to or cancel an order, we may attempt to notify you using the email, billing address, shipping address, or phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase, registration, billing, shipping, vehicle, class, media, sponsor, vendor, and account information. You agree to promptly update your account and other information so that we can complete transactions, fulfill orders, verify eligibility, provide event updates, and contact you as needed.

You are responsible for all purchases, registrations, forms, submissions, and activity made under your account or using your information.

SECTION 16 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, platforms, payment processors, shipping carriers, email systems, ticketing systems, registration systems, maps, social media platforms, analytics platforms, embedded content, or other services over which we do not monitor and have no control.

You acknowledge and agree that third-party tools and services are provided “as is” and “as available,” without warranties, representations, or conditions of any kind from us and without endorsement unless expressly stated.

We shall have no liability arising from or relating to your use of optional third-party tools or services. Your use of third-party tools or services is entirely at your own risk and discretion, and you are responsible for reviewing and complying with the terms and policies of the applicable third party.

SECTION 17 - THIRD-PARTY LINKS

Certain content, products, services, advertisements, sponsor references, vendor references, media references, and other materials available through our Service may include materials from third parties.

Third-party links may direct you to websites or services that are not affiliated with us. We are not responsible for reviewing or evaluating the content, accuracy, safety, privacy practices, policies, products, services, claims, statements, or operations of any third-party website or service.

We do not warrant and will not have liability or responsibility for third-party materials, websites, products, services, resources, advertisements, claims, statements, or transactions. Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third party.

SECTION 18 - USER COMMENTS, FEEDBACK, MEDIA, AND OTHER SUBMISSIONS

If you send creative ideas, suggestions, proposals, plans, photos, videos, testimonials, comments, reviews, event footage, social media tags, vehicle information, racer information, sponsor information, or other materials, whether at our request or without a request, and whether online, by email, by postal mail, by social media, by form submission, by direct message, by event participation, or otherwise, you agree that we may use those submissions as described in these Terms.

You grant J&L Horton LLC and Street Car Challenge a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, edit, publish, distribute, display, perform, create derivative works from, advertise with, promote with, and otherwise use your submissions, name, likeness, vehicle, business name, logo, statements, image, voice, and event-related content in any media now known or later developed, for marketing, promotion, documentation, news, editorial, social media, website, advertising, merchandise, sponsor, and event-related purposes.

We are under no obligation to maintain submissions in confidence, pay compensation for submissions, credit submissions, publish submissions, or respond to submissions.

You represent and warrant that you own or control all rights necessary to grant this license and that your submissions do not violate any third-party rights, including copyright, trademark, privacy, publicity, personal, proprietary, or contractual rights.

You may not use a false identity, false email address, misleading account, fake affiliation, or otherwise mislead us or third parties as to the origin of any submission. You are solely responsible for your submissions and their accuracy.

SECTION 19 - PHOTOGRAPHY, VIDEO, AND PUBLICITY NOTICE

By attending, entering, working, sponsoring, vending, covering, or participating in any Street Car Challenge event or related activity, you understand that photography, video recording, audio recording, livestreaming, interviews, and media coverage may occur.

You grant J&L Horton LLC, Street Car Challenge, event media, sponsors, vendors, photographers, videographers, and authorized representatives permission to photograph, film, record, livestream, publish, display, edit, distribute, and use your name, image, likeness, voice, vehicle, crew, business name, sponsor marks, and event participation for promotional, commercial, editorial, social media, website, documentary, advertising, and event-related purposes without compensation, notice, inspection, or approval, to the fullest extent permitted by law.

SECTION 20 - INTELLECTUAL PROPERTY

All website content, event names, logos, marks, graphics, photographs, videos, designs, text, page layouts, route materials, rules, event materials, sponsor materials, merchandise designs, and other content are owned by us or used by permission unless otherwise stated.

You may not copy, reproduce, distribute, sell, modify, create derivative works from, publicly display, use commercially, or exploit any content from this website or event without our prior written permission.

Nothing in these Terms grants you any ownership right, license, or permission to use the names J&L Horton LLC, Street Car Challenge, event logos, event designs, or related marks except as expressly authorized in writing.

SECTION 21 - PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy. Please review our Privacy Policy for information regarding how personal information may be collected, used, shared, stored, and protected.

These may relate to product descriptions, event descriptions, registration details, pricing, promotions, offers, shipping charges, transit times, availability, schedules, dates, times, locations, rules, routes, checkpoints, classes, payouts, sponsor benefits, or other information.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders, registrations, sponsorships, vendor approvals, or offers if information in the Service or on any related website is inaccurate at any time without prior notice, including after you have submitted an order.

No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information has been modified or updated.

SECTION 23 - PROHIBITED USES

In addition to other prohibitions set forth in these Terms of Service, you are prohibited from using the site, services, content, events, or related platforms:

(b) to solicit others to perform or participate in unlawful acts;
(c) to violate any international, federal, state, or local laws, rules, or regulations;

(n) to misuse event credentials, passes, tickets, registrations, sponsor benefits, media access, or vendor access.

We reserve the right to terminate your use of the Service or any related website, cancel orders, cancel registrations, deny access, remove you from events, and pursue any available legal remedy for violating prohibited uses.

SECTION 24 - DISCLAIMER OF WARRANTIES

We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, accurate, complete, or error-free.

We do not warrant that the results obtained from use of the Service will be accurate or reliable.

You agree that we may remove the Service for indefinite periods of time, cancel the Service, change the Service, or suspend the Service at any time without notice.

To the fullest extent permitted by law, J&L Horton LLC, Street Car Challenge, event owners, organizers, officers, employees, contractors, staff, volunteers, representatives, agents, sponsors, advertisers, vendors, media partners, service providers, affiliates, track owners, track operators, venues, property owners, property managers, insurers, and all related parties shall not be liable for any injury, loss, claim, damage, or any direct, indirect, incidental, punitive, special, exemplary, or consequential damages of any kind.

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, travel costs, lodging costs, fuel costs, vehicle damage, trailer damage, equipment damage, missed event participation, missed work, business interruption, personal injury, death, property damage, emotional distress, loss of goodwill, or similar damages arising from your use of the Service, purchase of any product, registration for any event, participation in any event, attendance at any event, use of event information, reliance on website content, or any other claim related in any way to the Service or an event.

If, notwithstanding these Terms, liability is imposed on us, then to the fullest extent permitted by law, our total liability shall not exceed the amount you paid directly to us for the specific product, registration, or service giving rise to the claim.

Some states or jurisdictions do not allow the exclusion or limitation of certain damages. In such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 26 - FORCE MAJEURE

We shall not be liable or responsible for any failure, delay, cancellation, postponement, modification, nonperformance, or disruption caused by events beyond our reasonable control.

Such events may include but are not limited to weather, rain, storms, flooding, lightning, fire, natural disasters, acts of God, road closures, accidents, emergencies, illness, epidemic, pandemic, government action, law enforcement direction, permitting issues, venue issues, track conditions, staffing shortages, vendor failures, utility failures, internet failures, payment processor failures, supply chain issues, shipping delays, fuel shortages, civil unrest, war, terrorism, labor disputes, insurance requirements, or other circumstances beyond our control.

SECTION 27 - DISPUTE RESOLUTION, VENUE, AND CLASS ACTION WAIVER

These Terms supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us regarding the Service.
